The Labour Court overturned a Rights Commissioner’s pay recommendation on Monaghan County Council’s appeal, finding the Council’s increased allowance fair and reasonable. The decision was dated 19 December 2006. A worker who operated a tar-patching machine sought continued pay relativity with Water and Sewage Caretakers Grade V. The Council said its allowance method did not create a link with that grade; it had raised the weekly allowance from €60.69 to €65.66. The union sought €95.81 a week. The Court rejected the claim for grade relativity and said the Council’s revised allowance should be accepted.
