Labour Court overturns regrading recommendation on Waterford hospital It Staff’s effective date

The Labour Court overturned a Rights Commissioner’s recommendation that Waterford Regional Hospital’s It Staff be regraded from July 1999, confirming 7 March 2002 as the correct date. The decision was signed on 20 December 2005. The union sought regrading and backdating to July 1999, when restructuring took place elsewhere in the HSE. The employer said the hospital’s posts were not sanctioned until March 2002. The Court found the posts could not have existed before 7 March 2002 and that the hospital had acted reasonably.
