The Labour Court affirmed the Rights Commissioner’s recommendation against a worker’s claim to continue acting as a Clinical Nurse Manager 2 and receive the associated allowance. The decision was signed on 3 August 2004. The union argued that seniority and custom and practice entitled the worker to the post. The Board said the worker chose not to apply for a confined competition and that similar vacancies had been filled by competition. The Court found the original recommendation reasonable in light of the case facts and disallowed the appeal.
