The Labour Court upheld the Rights Commissioner’s recommendation in favour of the Northern Area Health Board and disallowed a union appeal over a nurse’s eligibility for compensation under the Castlerea Formula, in a decision dated 17 December 2003. The union argued that the nurse suffered a financial loss after moving into community services and should qualify for compensation. The Board said the formula covered redeployment within the same area and that the worker had been recruited directly into community services from another health board. The Court upheld the recommendation.
