In 2001, the Labour Court recommended that R.T.E pay a worker £10,001.17 for outstanding time off in lieu and other leave, in full and final settlement. The decision was dated 18 December. The amount was agreed between the parties.

The worker had retired under an early retirement scheme. The Services Industrial Professional Technical Union said he had accumulated unused leave and hours that remained unpaid. R.T.E said it had met its annual-leave obligations and had offered ten weeks’ pay to settle the additional claim. The Rights Commissioner had recommended that the worker accept that offer after he and a representative did not attend the hearing.

The union appealed. The Labour Court found no agreement setting a maximum payment for outstanding time off in lieu and other leave on voluntary retirement, and said the appellant had neither agreed to nor known of a limit. It recommended payment of the full sum agreed between the parties.
