The Labour Court upheld a Rights Commissioner’s recommendation that Kilkenny Corporation pay a worker £360 over a dispute about a millennium payment for cemetery duties. The Court’s decision was dated 23 November 2001.
The union said the worker’s duties included cemetery upkeep and preparing graves, which required at least two operatives, and argued he had been on call over the relevant days. Management said he was not rostered or on call and was not among the Corporation’s five standby workers.
The Court said the dispute arose from a misunderstanding about how many cemetery workers were needed on standby. It did not consider it appropriate to interfere with the recommendation and disallowed the Corporation’s appeal. The worker is not named in the decision.
