The Labour Court upheld the Services Industrial Professional Technical Union’s appeal and awarded a worker £2,000 in compensation after finding she had not resigned from Donnelly Mirrors Limited. The decision was signed on 1 February 2000. A Rights Commissioner had found that the worker resigned and recommended in favour of the company. The Labour Court was influenced by the company’s failure to send her a P45, its continued VHI payments until mid-1998 and its payment of money due to her in May 1998.
