In 2001, the Labour Court dismissed a worker’s appeal concerning the allocation of work at Borage Services Ltd. The decision was dated 28 February 2001. The worker said he was kept on call and standby between 1993 and 1997 while a colleague had almost full-time work. Borage Services said he was a casual steward with no guaranteed hours, covering staff absences. The worker did not attend the resumed hearing. The Court said the Rights Commissioner’s recommendation was reasonable and affirmed it, dismissing the appeal. The earlier recommendation had said it was not reasonable to pursue the claim after the lapse of time.
