Wayne Ellis was sentenced to five years’ imprisonment for possessing a firearm in suspicious circumstances after the Court of Appeal ruling delivered on 25 July 2016. The offence arose after a shotgun was found in a car near Knocklyon Shopping Centre.
The court allowed the Director of Public Prosecutions’ sentence-review application, setting aside the fully suspended five-year term imposed by Dublin Circuit Criminal Court. It held that the trial judge could not suspend any part of the mandatory minimum sentence because Ellis had a previous firearms conviction.
The Court of Appeal upheld a separate fully suspended three-year sentence for possessing certain articles. Credit was ordered for time Ellis had already spent in custody on the firearms matter.
