W2 may seek injunction over planned Vikings sequel, High Court told

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

W2 Filmproduktion Vertriebs GmbH may seek an injunction over plans for a Vikings Valhalla series, its lawyers told the High Court on 28 November 2019. The proposed injunction would form part of its ongoing action against producers Morgan O'Sullivan and James Flynn.

W2 alleged that the producers diverted some €40 million from Octagon Films Ltd, in which they are all shareholders. Both men denied diverting the funds to themselves or companies they controlled.

W2 feared that funds generated by Vikings Valhalla, which it alleged should go to Octagon, would be diverted to the defendants. Its counsel said W2 considered this a breach of undertakings previously given to the High Court.

In its derivative action on Octagon’s behalf, W2 sought damages for alleged breach of duty, fraud and conspiracy. The producers denied diverting fees, income or opportunities due to Octagon. They said Octagon was a separate entity from the work-for-hire production services with which they were associated.

The defendants asked for more time to complete the discovery of documents, seeking an extension until December 2020. W2 opposed the application, arguing that they were trying to delay proceedings.
