W2 Filmproduktion claim against producers not fast-tracked

By Cathal Brosnan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

W2 Filmproduktion Vertriebs GmbH’s claim against Morgan O’Sullivan and James Flynn was refused fast-track treatment in the Commercial Court on 27 June 2016. The case concerns alleged diversion of funds from Octagon Films and claims for breach of contract and duty.

Mr Justice Brian McGovern found that delay, including correspondence dating to July 2015, disentitled W2 to the fast-track procedure. The proceedings will continue through the regular court lists.

W2 claims estimated losses of €25 million and alleges that funds, profits and income were diverted to the producers or companies they controlled. The defendants reject the allegations and describe them as unsubstantiated.
