Vincent Banks has IRA membership conviction quashed
This report is a localnews.ie summary based on public court reporting and records; sources are listed below.
Vincent Banks’ IRA membership conviction was quashed by the Supreme Court of Ireland on 10 February 2022.
The Court found his December 2012 arrest unlawful because it was connected to an earlier arrest for the continuing offence of IRA membership, and was made without a District Court warrant.
It also concluded that the prosecution evidence was insufficient to support the conviction, given the extensive privilege claim over the senior Garda officer’s belief evidence and the lack of adequate independent corroboration.
The appeal was allowed and the conviction overturned. The decision was reported on 11 February 2022.
