Victory Christian Fellowship loses appeal over receivership

By Rory Hanlon

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Victory Christian Fellowship lost its appeal in the Court of Appeal, reported on 11 June 2015, over Bank of Scotland’s appointment of receivers to three properties.

The trustees argued the appointments were invalid because the bank obtained unauthorised confidential information during debt negotiations. The court found the bank was contractually entitled to appoint receivers after the fellowship failed to repay €18.76 million in loans secured against the properties.

The trustees acknowledged that €18.76 million was due and owing and did not appeal that judgment. The properties were at Kilmacud House, Westland Row and Firhouse Road, Tallaght, and the receivers were entitled to injunctions preventing interference with taking possession.
