Unnamed man faces trial after phone evidence admitted

By Gráinne Nolan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

A 40-year-old man who cannot be named by order of the court is facing trial for false imprisonment and intentionally causing serious harm at the Special Criminal Court after CCTV and mobile phone evidence was admitted. The four accused had pleaded not guilty. The proceedings were reported on 9 June 2021, and the admissibility ruling was reported on 8 July 2021.

The defence argued that privacy rights had been breached through access to CCTV footage and phone data, including a warrant allegedly executed at the wrong address. The court found the warrants validly issued, rejected the mass-surveillance argument and excluded some footage from Derrylin and County Longford. The trial was continuing before Mr Justice Tony Hunt, Judge Gerard Griffin and Judge David McHugh.
