Costs reserved to trial judge in Cavan property case

By Cathal Brosnan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The Court of Appeal’s record in Fox v Reilly & Anor states that costs in both the High Court and Court of Appeal were reserved to the trial judge. The record lists a judgment by Ms Justice Hyland delivered on 10 October 2025.

Earlier, on 7 February 2025, Sylvia Fox secured a High Court injunction preventing Martin Reilly and Donna Heslin from continuing to occupy a house at Lock Eala, Loch Gowna, Co Cavan. Ms Fox had bought two houses in the estate in March 2024 after the developer, who was also the landlord, went bust.

The court heard that Mr Reilly and Ms Heslin claimed an agreement with the previous landlord under which they paid €20,000 as a purchase option and €100 a year in rent from 2016. Mr Justice Oisín Quinn found that Ms Fox had established a very strong case and was the lawful owner. He said the claimed lease did not bind or affect the transfer of the mortgage from Everyday to Ms Fox.

The judge granted the couple a two-month pause on the vacation order and postponed awarding costs to Ms Fox until the outcome of their appeal.

This case may have concluded differently. The outcome has not yet been confirmed by a public source we could find.
