A 29-year-old man who cannot be named for legal reasons has pleaded not guilty to one count of rape at the Central Criminal Court. The alleged incident occurred at a Dublin apartment in the early hours of 28 September 2008. The proceedings were reported on 12 October 2016.
A sleep expert told the jury that the accused fitted the template for sexsomnia and was unaware of what he had done. However, he also told the jury that having had sexsomnia previously did not mean the accused had it at the time of the alleged incident.
The trial continued before Mr Justice Patrick McCarthy and a jury of eight men and four women.
