Tom O'Gorman's family has been granted a transcript of the murder trial after raising concerns about the HSE's care of Saverio Bellante. Ciarán Craven SC applied for the transcript or digital audio recording on the family's behalf on 19 February 2018. The proceedings were reported on 19 February 2018.
A Central Criminal Court jury found Bellante not guilty by reason of insanity of murdering O'Gorman at their shared home in Castleknock, Dublin. Bellante was O'Gorman's lodger at the time of the killing in January 2014. After the special verdict in July 2015, Ms Justice Margaret Heneghan ruled that Bellante should be detained indefinitely at the Central Mental Hospital in Dublin.
Mr Craven said the family had applied for the inquest to be reopened. He said they were concerned that the death may have been brought about by the way Bellante was treated by the HSE and a named doctor, and submitted that the narrative history of Bellante's mental ill health was inaccurate.
The coroner had received the transcript subject to restrictions preventing its disclosure to other parties. Mr Craven said the family considered those restrictions a disadvantage and that neither the DPP nor Bellante's legal team opposed the application. Mr Justice Patrick McCarthy directed that a transcript be provided.
