Tom Colton received a fully suspended nine-month sentence and a 10-year company-director disqualification at Dublin Circuit Criminal Court on 7 April 2025.

Colton pleaded guilty to acting as a director of Grá Agus Solas ULC while disqualified between August 2016 and May 2018. He admitted acting as a director and secretary in a manner prohibited by a disqualification order, and being directly concerned in the company’s formation and management. The proceedings were reported on 7 April 2025.

Detective Garda Gary Callanan told the court that Colton received an automatic five-year directorship disqualification on 5 December 2014, after being sentenced to four years in prison, with 18 months suspended, for the theft of €322,000.

The report said Colton filed company papers in 2016 using his Irish name, Tomás Mac Cultan. Colton told gardaí he used that name to avoid media attention after his conviction and learned only later that he was disqualified.

Under cross-examination by defence barrister Cathal Ó Braonáin, Det Gda Callanan agreed that the disqualification had not been mentioned in court on the day of the theft conviction. He accepted that Colton became aware of it in 2018 and immediately resigned, four years before the investigation.

The judge noted that there was no system for informing people when they were automatically disqualified. She regarded Colton’s guilty plea as valuable and said his consent to a longer disqualification was evidence of remorse.
