Tezaur Bita wins appeal over public urination charge

By Tadhg O'Sullivan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Tezaur Bita was granted leave to challenge a public urination charge in the Court of Appeal, reported on 25 October 2016. He is alleged to have urinated in bushes beside the Old Nangor Road after parking there in the early hours of 27 August 2015.

The Court of Appeal reversed the High Court refusal of permission, finding that Bita’s argument that the indecent-exposure offence is unconstitutionally vague was arguable. The case was made returnable to the High Court in December.
