Norton (Waterford) Limited, trading as Teva Pharmaceuticals Ireland, had its patent dispute with Chiesi Farmaceutici SPA admitted to the Commercial Court’s fast-track list on 2 December 2019.

Teva claims three Chiesi patents covering asthma and severe COPD treatments are invalid because they lack novelty, an inventive step and clear disclosure.

The Waterford company is seeking declarations revoking patents granted in 2007 and 2008, which are due to expire in 2027 and 2028.

Mr Justice David Barniville admitted the action with Chiesi’s consent and adjourned it to a date in April.
