Supreme Court refuses father and son’s further appeal; no prosecution will proceed

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The Supreme Court refused Nicolae and Florin Mazarache permission to bring a further appeal over fixed penalty notices issued after they were stopped at Dublin Airport in 2021. The court said their case had been moot since November 2025, when the Director of Public Prosecutions directed that they would not be prosecuted.

The pair had challenged notices alleging an offence of movement of persons at a port or airport under the Health Act 1947. The High Court dismissed their challenge in February 2024, and the Court of Appeal dismissed their appeal in October 2025. The Supreme Court said there was no question of injustice because no prosecution would take place.
