Stephen and Karen Costello keep harassment case alive

By Eimear Byrne

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Stephen Costello and Karen Costello retained their High Court claim alleging harassment after a judgment dated 14 October 2014 refused to dismiss the proceedings. The allegations concern conduct at their home in Woodstown Gardens, Dublin 16.

The Commissioner of An Garda Síochána had sought dismissal because of what the judgment described as inordinate and inexcusable delay. Mr Justice Michael White found the case could continue, taking account of the nature of the allegations and the absence of serious prejudice to the defence.

The judge also vacated an earlier injunction restraining Garda personnel from entering the couple’s home except under warrant or at a household member’s request. The substantive action had not been heard by the motion hearing on 14 May 2014.
