Stateline Freight refused a stay on planning breach order

By Fionn Kelly

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Stateline Freight Limited was refused a 12-month stay by the High Court on 13 November 2023, leaving an order to stop unauthorised container storage in force.

The company had agreed to an injunction requiring it to cease storing shipping containers at Compass Distribution Park in Santry, Dublin, where it had no planning permission for the activity.

The judge gave Stateline six weeks to remove the containers, finding no discretionary features justified delaying the order. He said the breach was conscious and deliberate.

The judgment said an economist’s evidence did not establish that the economic effects of closure made it in the public interest to allow the unauthorised use to continue for another year. Retention permission had been refused, and that decision was under appeal to An Bord Pleanála.
