St Mary’s Centre (Telford) faced a High Court application for examinership. The proceedings were reported on 23 September 2020.
The south Dublin nursing home and disability care centre operates beside St Vincent’s Hospital on Merrion Road.
Residents and some current and former staff sought a short examinership period to assess whether the facility could be saved.
Their counsel, John Kennedy SC, said an independent expert’s report found the company could survive if steps were taken, including appointing an examiner to develop a survival scheme with creditors and seeking interest from potential investors. He accepted that no investor had been identified.
The company opposed the application, saying it was insolvent and had no prospect of survival.
Provisional liquidators had been appointed in July. The winding-up application was brought on the grounds that the facility could not meet €950,000 in redundancy payments arising from liquidation.
The HSE was neutral on the examinership application and was discussing taking over the care facility during an estimated 12-to-18-month transition.
The hearing before Mr Justice Michael Quinn was continuing.
