Six Dublin men accused of IRA membership had their arrests ruled unlawful by the Special Criminal Court on 26 June 2015. The arrests followed a search at a house in Glenshane Crescent, Tallaght.
The court found the arrests fell short of the necessary objective justification required for suspicion of IRA membership. The six were Brian Nick McBennett, Kevin Braney, Michael Barr, John Brock, Declan Phelan and Desmond Christie.
A seventh accused, Peter Burns, did not challenge the legality of his arrest. The prosecution then sought an adjournment to take instructions from the Director of Public Prosecutions, with the case due to return on Tuesday.
