Sharon Browne and David Egan lost their bid for a protective costs order in the High Court, reported on 25 April 2023.

Mr Justice Michael Twomey ruled that the applicants had failed to meet the conditions for such an order. He said the court was not satisfied their action had a real prospect of success and considered it an abuse of process. The ruling concerned proceedings that sought, among other things, to prevent Covid-19 vaccination of children aged five to 11.

The judge took the provisional view that the three applicants should pay the costs of the one-day preliminary hearing; he invited submissions and adjourned that costs issue to a date the following month.
