Sergey Chesnokov had the ruling recognising his Irish citizenship overturned by the Court of Appeal, reported on 3 February 2017. The court unanimously upheld the Registrar General’s appeal against the High Court decision.
The High Court had previously found that Chesnokov was born in Dublin in September 1940 and ordered his birth to be registered in Ireland. The Court of Appeal found the documentary evidence did not establish that claim on the balance of probabilities.
The High Court’s registration order was vacated. The court also found that Chesnokov’s challenge to the Registrar General’s original refusal had been brought out of time.
