Seán Walsh’s Supreme Court appeal against surrender for alleged terrorism offences was stayed and referred to the Court of Justice of the European Union on 22 October 2024; the alleged offences took place in Omagh, County Tyrone.
The Court of Justice was asked to consider whether applying the UK’s newer sentencing rules could breach Mr Walsh’s rights by imposing a heavier penalty than the rules in force when the alleged offences occurred.
Mr Walsh is wanted in Northern Ireland on charges including directing terrorist activities and membership of the IRA. He denies the charges. The High Court ordered his surrender in October 2022, and he appealed.
