Robert Maguire resentenced for assault and false imprisonment
This report is a localnews.ie summary based on public court reporting and records; sources are listed below.
Robert Maguire was resentenced to four years in prison on each of two counts following a successful prosecution appeal. The sentences run concurrently, with the final 12 months of each suspended for three years, leaving a three-year custodial term. He was required to enter into a good behaviour bond for the suspended period and undertook to be bound by it.
Maguire had pleaded guilty at the Central Criminal Court to assault causing harm and false imprisonment. The offences took place at his former partner’s Dublin home on 14 January 2012. The proceedings were reported on 8 March 2018.
On 6 July 2017, Mr Justice Paul Butler imposed two concurrent four-year sentences, suspending the final two years of each. The Director of Public Prosecutions successfully sought a review, and the three-judge court found the resulting two-year custodial term unduly lenient.
Giving judgment, Mr Justice Alan Mahon sat with Mr Justice George Birmingham and Mr Justice John Edwards. Mr Justice Mahon said Maguire had 13 previous convictions. The court noted that Maguire had taken impressive steps while in prison and encouraged him to continue.
