River Medical settles Dublin rent arrears dispute

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

A rent arrears dispute involving River Medical and its landlord was resolved after talks between the parties.

The case was listed for hearing before Mr Justice Paul Gilligan at the High Court on 3 May 2017. Hugh O’Keeffe SC, for Merrion Property Group Ltd, said after the talks that the matter had been resolved.

Merrion had brought proceedings against Shelton Investments Ltd, trading as River Medical, over premises at 114 Lower Baggot Street. It claimed more than €161,000 in rent arrears and sought to terminate the lease and obtain vacant possession.

River Medical denied the arrears claim. In a counterclaim, it said some arrears were due but that it had agreed a rent reduction with the previous landlord in 2013 because of the economic climate. It sought declarations that it was entitled to remain in possession and that Merrion was precluded from denying the rent reductions.

The settlement terms included River Medical vacating the premises and handing possession to Merrion at the end of June, and paying Merrion €130,000.
