Randa Murphy’s hip implant claim requires PIAB authorisation
This report is a localnews.ie summary based on public court reporting and records; sources are listed below.
Randa Murphy’s claim against DePuy International over an allegedly defective hip implant was ruled to require Personal Injuries Assessment Board authorisation by the High Court, reported on 21 January 2015. The ruling concerned her damages action arising from hip surgery and a later recall of the implant system.
Ms Justice Mary Faherty rejected the argument that the claim arose from the provision of a healthcare service, finding that it concerned the manufacture, supply and provision of an allegedly defective implant. Murphy’s lawyers had also brought parallel proceedings supported by PIAB authorisation, while the matter was adjourned to early the following month for the parties to consider the ruling.
