Pembroke Road Association won part of its planning challenge when the High Court upheld its claim on 16 June 2021 that a permission condition was invalid. The challenge concerned fast-track permission for 105 apartments and 10 aparthotel bedrooms at Herbert Park Road, Ballsbridge.
Mr Justice Alexander Owens rejected the residents’ arguments about public open space, building height and the cultural significance of the demolished O’Rahilly house. He said the court would later decide whether to quash the permission or allow An Bord Pleanála to correct the invalidity, with the case returning for submissions on the appropriate order.
