Paul Kelly was fined €3,000 and disqualified from driving for four years at Dublin Circuit Criminal Court. Judge Melanie Greally gave him 12 months to pay the fine.
Kelly pleaded guilty to driving without due care and attention, thereby causing serious bodily harm. The offence took place on 26 October 2016. The proceedings were reported on 9 October 2018.
Daniel Ryan suffered multiple fractures and a pulmonary embolism after Kelly struck him while pulling out of a driveway onto an unlit road near Dublin Airport. Ryan spent weeks in hospital and gave up his part-time job.
Garda Philip Murray accepted that the manner in which Kelly drove out of the driveway did not give him an opportunity to see Ryan. The road had no street lighting, although Ryan carried a torch.
Judge Greally said the lighting meant Ryan was not conspicuous on the pathway, but Kelly's driving required greater care and attention. She accepted that Kelly behaved responsibly immediately afterwards and had shown remorse.
Garda Murray said Kelly stopped and contacted the emergency services. He had no previous convictions.
