Patrick Hutch trial listed to resume in December

Patrick Hutch’s trial at the Special Criminal Court was listed to resume “in some form” on 3 December 2018, presiding judge Mr Justice Tony Hunt said. The proceedings were reported on 9 November 2018.
Hutch has pleaded not guilty to murdering David Byrne at the Regency Hotel in Dublin on 5 February 2016. He also denies possessing three AK47 assault rifles in connection with the shooting.
Senior prosecuting counsel Sean Gillane SC said the final report into the death of lead investigating garda Colm Fox had been received and he hoped the defence would receive it by the end of the day. He said the extensive material behind it still had to be reviewed.
Justin McQuade BL, for Hutch, said the defence had been told the report would be available around 22 October, leaving it further frustrated. He said the defence would consider the report and put any views in writing to the Director of Public Prosecutions.
Mr Justice Hunt, sitting with Judge Patricia Ryan and Judge Ann Ryan, remanded Hutch in custody until 23 November, when the case was listed for mention. Earlier adjournments concerned electronic data examined in the inquiry into Fox’s death and emails exchanged between four gardaí.
The prosecution’s case was that Hutch was a man dressed as a woman during the raid at a boxing weigh-in and, although he did not shoot Byrne, was part of a shared intention to commit the offence.
