This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

O’Flynn Capital Partners challenged An Bord Pleanála’s refusal of planning permission in the Commercial Court on 9 October 2017. The proposed development at Beech Park, Bray Road, Cabinteely, Dublin 18, included 34 houses and an access roadway.

The judicial review was admitted to the fast-track Commercial Court list by Mr Justice Brian McGovern. The company seeks to have the board’s decision quashed, arguing that the board erred in law and considered irrelevant matters.

The company said it had spent about €15 million on land and planning fees, with construction costs estimated at a further €50 million. The case was due to return before the court in November.
