The family of Tom O'Gorman was granted the transcript of Saverio Bellante’s murder trial after an application to the Central Criminal Court. The proceedings were reported on 19 February 2018.
Ciarán Craven SC applied for the transcript or digital audio recording on the family’s behalf on 19 February 2018. The application came before Mr Justice Patrick McCarthy, who directed that a transcript be provided.
A Central Criminal Court jury found Bellante not guilty by reason of insanity of murdering O'Gorman. The special verdict was delivered in July 2015, and Ms Justice Margaret Heneghan ordered Bellante’s indefinite detention at the Central Mental Hospital in Dublin.
The coroner had earlier applied to Ms Justice Heneghan for the transcript. It was released for the coroner’s use alone, with a restriction against disclosing it to other parties.
Mr Craven said the family had concerns about the management of Bellante’s mental health and submitted that the inquest was the only way to explore those issues. He said neither the Director of Public Prosecutions nor Bellante’s legal team objected to the family’s application.
