Niall Colgan received a one-year prison sentence, suspended in full on strict conditions, at Dublin Circuit Criminal Court. Judge Martin Nolan noted that Colgan would be on the sex offenders register for five years.
Colgan pleaded guilty to one count of possessing child pornography, comprising two indecent videos and two indecent images of children, at his home on 1 February 2022. The proceedings were reported on 7 May 2024.
Detective Garda Alan Young told the court that gardaí searched Colgan’s home on 1 February 2022. Material was found after his personal phone was analysed. Colgan told gardaí under caution that he had never touched children and that the photos were taken from TikTok and Instagram.
Young accepted the defence’s account that the material was found among an extensive collection of adult pornography. He also accepted the defence suggestion that pandemic isolation and overuse of alcohol and cannabis had played a significant part in Colgan’s downward spiral.
Colgan had no previous convictions. The court heard he had attended counselling and had been assessed at low risk of reoffending. Judge Nolan referred to his previous good character, family support and the help he had obtained.
