Mohammad Daud Assad secures €3m birth injury settlement

By Fionn Kelly

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Mohammad Daud Assad secured a €3m interim settlement in the High Court on 11 February 2016 over alleged birth injuries at Dublin’s Rotunda Hospital.

The settlement followed claims that a delay in delivering him by caesarean section caused severe brain injuries. Liability had been admitted, and the hospital consented to the settlement.

Mr Justice Kevin Cross approved the agreement and adjourned the matter for six years, after which Mohammad’s future care needs are to be assessed.

The interim payment is intended to cover damages and costs including past and continuing care, housing, specialised equipment and music therapy. Mohammad has cerebral palsy and will require full-time care for the rest of his life.
