Michael Fagan was jailed for five years for attempted robbery and possessing an imitation firearm with intent to commit robbery at Dublin Circuit Criminal Court, reported on 1 July 2015. The offences occurred at Collins Food Store on Mount Pleasant Avenue, Dublin 6, on 22 May 2014. Fagan had pleaded guilty to both charges.
The court heard that Fagan pointed the realistic-looking replica gun at Garda Brendan O’Toole while the officer restrained a teenage accomplice during the attempted raid. Fagan had 48 previous convictions, including burglary, assault and criminal damage. Judge Martin Nolan said the officer had reason to believe he was going to die.
