Maximilian Lang-Orsini pleaded guilty at Dublin Circuit Criminal Court to sexual assault. Judge Martin Nolan sentenced him to two years in prison, suspended in full for two years. The proceedings were reported on 24 July 2019.
The offence took place on Hanover Lane, Dublin, on 16 November 2013. Garda Ian O’Brien told prosecuting counsel Antonia Boyle that the 64-year-old woman was on her way to the pub when she heard someone behind her. She turned and saw Lang-Orsini exposing himself and masturbating in front of her.
The report said he laughed as she tried to run away, tripped and fell. He came closer and stood over her while still masturbating and laughing, but did not touch her. A local responded to her screams and chased him away. She attended hospital the following day and discovered that she had dislocated her shoulder.
Nolan ordered Lang-Orsini to raise €10,000 and hand it to Garda O’Brien within 18 months. The judge said that if the woman did not want the money, the court would dispose of it. He described the sum as a punishment intended to deter Lang-Orsini.
The judge accepted Boyle’s submission that the sexual assault charge arose from the woman’s apprehension that she was about to be sexually assaulted. He also accepted that Lang-Orsini had not intended to injure her or physically sexually assault her. Lang-Orsini had no previous convictions.
Defence counsel Ger Small said Lang-Orsini apologised unreservedly. She said he had become isolated while attending college in Ireland and had begun taking MDMA. She said her instructions were that he was intoxicated on drugs at the time.
