Maureen Kelly loses appeal over Dublin 4 tenancy termination

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Maureen Kelly lost her appeal at the High Court against the Residential Tenancies Board’s decision upholding her landlord’s notice to end her tenancy, in a judgment on 28 November 2024. The rented home was on Morehampton Road in Donnybrook, Dublin 4.

The board had found that Miracove Holdings Ltd intended to sell the property and directed Kelly to leave within 42 days, as well as pay €60,000 in rent arrears. Kelly argued that the landlord’s directors lacked direct knowledge of the intention to sell when the termination notice was served.

Justice Conleth Bradley said the board was entitled to find there was sufficient evidence that Miracove intended to sell. The company had decided not to market the property until it was secured and vacant possession was established.
