Mary Walsh lost her High Court application to sue An Post National Lottery Company over alleged negligent lottery advice, reported on 19 October 2020. The former operator was in voluntary liquidation, requiring court permission before proceedings could be brought. Ms Justice Teresa Pilkington ruled that the alleged negligence had already been determined in earlier proceedings brought by Walsh’s stepson, David Walsh.
The judge found that allowing the proposed claim to proceed would constitute an abuse of process and dismissed the application. Walsh had alleged that advice about signing a winning ticket led to disputes over a 2011 €3.3m Lotto jackpot.
