Mark Whelan was found guilty of murdering Noel Whelan at the Central Criminal Court on 11 October 2021. The verdict followed his trial for the killing at Noel Whelan’s home in Dublin on 30 March 2019.
The jury rejected Whelan’s defence that he was psychotic through voluntary drug intoxication and did not know the nature or wrongfulness of his actions, or could not prevent them. It returned a unanimous verdict after two hours’ deliberation.
The judge had told jurors that the psychiatric evidence did not meet the threshold for a verdict of not guilty by reason of insanity or guilty with diminished responsibility. The court adjourned the case to 15 November for sentencing and victim impact statements.
