A 35-year-old man who cannot be named to protect the victim’s identity was sentenced at the Central Criminal Court to four years in prison, with the final year suspended for three years. The proceedings were reported on 31 May 2024.
He pleaded guilty to sexually assaulting the woman and to stealing and putting her in fear of being subjected to force. The offences took place at Drimnagh Luas Stop, Davitt Road, Dublin 12, on 26 January 2023.
Mr Justice Paul McDermott set a six-year headline sentence. He noted the defendant’s mental health problems and history of schizophrenia in mitigation. The sentence was backdated to 30 April 2023.
The judge said the man held the woman’s legs apart while his female co-accused searched her vagina, and that the sexual assault could not have been carried out without his assistance. The co-accused, who also cannot be named to protect the victim’s identity, was jailed for three years in January 2024 after pleading guilty to sexual assault and robbery on the same occasion.
