Man has four-year sexual assault sentence suspended on appeal

By Orla Quinn

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The unnamed man had his four-year sentence for sexual assault suspended in full by the Court of Appeal on 24 November 2014, after the Director of Public Prosecutions appealed his original sentence. The offence occurred in a Dublin suburb on 15 July 2012 while the victim’s eight-year-old son was in bed beside her.

He had pleaded guilty at Dublin Circuit Criminal Court and initially received a two-year suspended sentence in July 2013. The appeal court found that sentence unduly lenient, placing the offence in the mid range of seriousness, but suspended the replacement sentence in full because of mitigating circumstances including his guilty plea, cooperation and remorse.
