KPW Business Forms Ltd won an order for legal costs in the High Court, reported on 5 March 2019, after challenging the State Examinations Commission’s award of an online exam-marking tender.
The Ballinasloe company, trading as KPW Print, had sought judicial review after the SEC awarded the contract to a rival UK firm for €5m. The tender was later withdrawn, making the proceedings moot. Mr Justice Max Barrett rejected the SEC’s argument that both sides should pay their own costs, finding that the proceedings had led to the contract being withdrawn.
