KPW Business Forms Ltd was awarded legal costs by the High Court in its tender challenge, reported on 5 March 2019.
The Ballinasloe company had challenged the State Examinations Commission’s decision to award a €5m online marking contract to RM results.
The tender was later withdrawn, making the judicial review proceedings moot. The SEC had opposed the costs application and argued that each side should pay its own costs.
Mr Justice Max Barrett held that the proceedings had caused the contract award to be withdrawn and made an order for costs in KPW’s favour.
