Kim Ng Swan received a fully suspended nine-month sentence for one count of careless driving causing the death of Jose Eduardo Silba Pereira at Dublin Circuit Criminal Court on 1 December 2023. Judge Orla Crowe also disqualified her from driving for one year.
Swan pleaded guilty. Pereira died after Swan turned right and failed to see his motorbike approaching on Kimmage Road West on 30 December 2021. The defence noted that Pereira was travelling at about 80km/h in a 50km zone and that Swan's car had slowed to 17km/h; Detective Garda Peter Lyons agreed she might have completed the turn if he had been travelling at the speed limit. The proceedings were reported on 1 December 2023.
