Killiney residents win permission to challenge housing scheme

Eight Killiney residents were given permission to pursue a judicial review of An Bord Pleanála’s approval for a housing development, at the High Court on 14 December 2021.

The challenge concerns permission for 255 homes off Church Road. Mr Justice David Holland said the applicants had sufficient interest and had raised substantial grounds for the case to proceed.

Atlas GP, part of the Marlet group, had separately sought an injunction to stop steps in the residents’ challenge, alleging third-party funding breached the rules on champerty and maintenance. The residents say Atlas’s injunction action is an abuse of process.

Atlas said it intended to apply to set aside the permission to proceed.
