Kevin Malone was sentenced to nine months in prison at Dublin Circuit Criminal Court on 20 February 2018.
Malone pleaded guilty to one count of violent disorder. The offence took place at Tallaght Hospital on 18 September 2016. The proceedings were reported on 22 February 2018.
Garda Colin Hetherington said hospital CCTV showed Malone and two other men carrying out the attack. The court heard that one man hit the victim with a wooden pole. After the victim fell, Malone kicked and punched him in the lower back.
Kieran Kelly BL, defending, said the incident arose after the victim took a mobile phone and the three men were seeking its return. He said Malone punched the victim once and kicked him four times, was remorseful and had submitted a letter of apology.
Judge Martin Nolan described the attack as violent and accepted Malone was the lesser involved. He backdated the sentence to the previous September, when Malone first went into custody.
